How to Respond to Complaints of Discrimination

The University's Title IX-based regulations protect against unwelcome sex-based conduct, and support sex-based equity. Complaints brought forth about sex-based disparate treatment, harassment, stalking, domestic violence, or about rape or sexual assault, whether brought by a male or female, should be referred and reported to OIE. Please make a record of your actions. 

The University's Nondiscrimination and Anti-harassment Policy protects against unwelcome conduct that is occurring due to membership in one or more protected categories - race, color, religion, sex, national origin, age, disability, veteran status, sexual orientation, gender identity, or genetic information. Both Title IX and the Nondiscrimination and Anti-harassment Policy prohibit unlawful retaliation, an adverse action taken against an individual based upon their participation in a protected activity, which includes objecting to discriminatory behavior or participating in an investigation into discriminatory behavior. 

Anyone complaining about any protectected category-based discrimination/harassment should be referred to OIE and the concern should be reported to OIE by the faculty member or supervisory employee who recieved it. The recipient should make a record of these actions. 

Complaints brought by a third party (bystander/witness), should be handled in the same manner. Note that complaints may come from students or subordinates. The obligation lies with the faculty member  or supervisory employee to make the referral. Recipients may choose whether to utilize the referral and contact OIE, but they are under no obligation to do so. 

If you are approached about or become aware of discriminatory conduct, take action with "The 3 Rs":

Refer

  • In person, show empathy, neutrality, provide a Title IX brochure, and refer to OIE.
  • Follow up by email, reminding the concerned party that OIE (or DOS) is the campus resource for handling discriminatory treatment. Please do not include a heavily detailed report of the alleged conduct or make conclusions that laws/policies have been violated. 
  • Provide contact advice: www.equity.arizona.edu, equity@email.arizona.edu and 621-9449. 
  • Attach brochures to the email (Title IX & OIE)
  • Locate Title IX and discrimination prevention brochures. 

Report

  • "cc" OIE in the same outgoing email at equity@email.arizona.edu
  • (You may decide to call OIE yourself if the alleged conduct is egregious, or presents a continuing danger, and you are concerned the student will not reach out for assistance).

Record

  • The email is a record of your actions, maintained in your files, as well as OIE's.

Please encourage colleagues and grad students to take online training and to familiarize themselves with all the concepts above. OIE will provide you a sample of "The 3 Rs" email upon request.
